1. Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of Nundinal ("Nundinal", "the Service"), the web application at nundinal.io. By creating an account, or by accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Please also read our Privacy Policy, which explains how we handle your personal data and forms part of your agreement with us.

2. Who operates Nundinal

Nundinal is operated by a private individual based in Switzerland (the "Operator", "we", "us", "our"). Because Nundinal is currently an independent, early-stage project, we operate under the Nundinal name rather than a registered company. 3. Eligibility

You may use Nundinal only if you are at least 18 years old and have the legal capacity to enter into a binding contract. By using the Service you confirm that you meet these requirements, that you are not barred from using the Service under the laws of your jurisdiction, and that any information you give us is accurate.

4. What Nundinal is — and what it is not

This section is the most important part of these Terms. Please read it carefully.

Nundinal is a planning, monitoring, and record-keeping tool for cryptocurrency conversion strategies. With Nundinal you can:

  • design conversion strategies (for example dollar-cost-averaging over time, single price-triggered conversions, and probability-distributed selling across price ranges);
  • have the Service watch prices and time conditions on your behalf and notify you by email when a condition you defined is met; and
  • record and trace the trades you carry out, so that every fund movement in your records has a clear history and cost basis.

Nundinal does not execute trades, and never touches your funds. Specifically:

  • We do not place orders, buy, sell, or trade on your behalf. When one of your strategy conditions is met, Nundinal tells you — it is then entirely your decision whether, when, and how to act. Any trade is carried out by you, on your own exchange or wallet.
  • We never hold, custody, receive, send, or control your cryptocurrency or money. Nundinal only stores the records and plans that you enter or that the Service computes from them.
  • If you choose to connect an exchange or blockchain address, our access is strictly read-only. Nundinal fetches balances and transaction history only. It cannot and does not place orders, initiate withdrawals, or change anything on your exchange account. We strongly recommend you create read-only (view-only) API keys with no trading or withdrawal permissions, and only ever provide those.

Because of the above, Nundinal is not a broker, dealer, exchange, trading platform, custodian, wallet, money transmitter, payment service, or investment fund. We are not a party to any trade you make, and we have no ability to affect your assets.

5. No financial, investment, tax, or legal advice

Nundinal is a tool that helps you automate the timing and discipline of decisions you make. It does not provide financial, investment, tax, or legal advice, and nothing in the Service is a recommendation to buy, sell, or hold any asset.

Prices, projections, balances, cost-basis figures, and lineage records shown in the Service are based on data you enter and on third-party market data, and may be incomplete, delayed, or wrong. You are solely responsible for your own decisions. Cryptocurrency is highly volatile and you may lose some or all of the value of your holdings. If you need advice, consult a qualified professional.

6. Your account and security

You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to:

  • provide a valid email address and choose a strong, unique password;
  • keep your login details and any exchange API keys you enter secure; and
  • notify us promptly at [email protected] if you suspect unauthorized access.

We protect account passwords with strong one-way hashing (Argon2), and we encrypt sensitive secrets — such as two-factor-authentication (2FA) secrets and any exchange API credentials you provide — at rest. We offer optional two-factor authentication, which we recommend you enable. No system is perfectly secure, however, and you use the Service at your own risk (see Sections 12 and 13).

7. Acceptable use

You agree not to:

  • use the Service in violation of any applicable law or regulation, including sanctions, anti-money-laundering, and securities laws;
  • access or attempt to access another user's account or data;
  • probe, scan, or test the vulnerability of the Service except through responsible disclosure to [email protected], or breach or circumvent any security or authentication measure;
  • interfere with, overload, or disrupt the Service or its infrastructure, including by automated scraping, denial-of-service, or circumventing rate limits;
  • upload malicious code, or use the Service to store or transmit unlawful content; or
  • misrepresent your identity or provide credentials you are not authorized to use.

We may investigate and take appropriate action, including suspending or terminating accounts, for any violation.

8. Your data and content

You retain all rights to the data and content you enter into Nundinal (your portfolios, plans, records, profile image, and similar). You grant us only the limited permission needed to host, process, back up, and display that content to you in order to operate the Service. We do not sell your data. How we handle personal data is described in the Privacy Policy.

You are responsible for the accuracy of the data you enter. Nundinal's records are only as correct as the inputs you give it.

9. Third-party services

If you connect an exchange, blockchain address, or other third-party service, your use of that service is governed by that provider's own terms and privacy policy. You are responsible for your relationship with those providers, for the permissions of any API keys you create, and for complying with their terms. We are not responsible for third-party services, their availability, or their data.

The Service also relies on third-party market-data and infrastructure providers (described in the Privacy Policy) whose availability and accuracy we do not control.

10. Fees

The Service is currently free of charge. We may introduce paid features in the future; if we do, we will announce pricing in advance, and continued use of any paid feature will require your explicit agreement.

11. Beta / early-access status

Nundinal is offered on an early-access basis. Features may change, break, or be removed; data may occasionally be lost or corrupted; and the Service may be unavailable at times. We do not guarantee that the Service will be uninterrupted, timely, secure, error-free, or that any notification will be delivered or delivered on time. You should not rely on Nundinal as your only record of your holdings or as a guaranteed alerting mechanism.

12. Disclaimer of warranties

To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or availability. We do not warrant that the Service, any market data, any calculated figure, or any notification is accurate, complete, current, reliable, or delivered on time. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

13. Limitation of liability

To the fullest extent permitted by applicable law:

  • Nundinal, the Operator, and anyone acting on our behalf will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, trading losses, loss of assets, loss of data, or lost opportunity, arising out of or relating to your use of (or inability to use) the Service — including any missed, late, or incorrect notification, any inaccurate figure or record, or any decision you made using the Service.
  • Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the total amount you paid us to use the Service in the twelve months before the event giving rise to the claim, or (b) fifty Swiss francs (CHF 50).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — including liability for death or personal injury caused by negligence, for fraud, or for intent or gross negligence. Because Nundinal never executes trades and never holds your funds (Section 4), any losses on your actual holdings arise from your own trading decisions and market conditions, not from the Service.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless the Operator from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

15. Suspension and termination

You may stop using Nundinal and delete your account at any time from your account settings (see the Privacy Policy for what deletion erases). We may suspend or terminate your access, with or without notice, if you breach these Terms, if we are required to by law, or if we discontinue the Service. On termination, the sections that by their nature should survive (including Sections 4, 5, 8, 12, 13, 14, and 18) continue to apply.

16. Changes to the Service

We may add, change, or remove features, or discontinue the Service in whole or in part, at any time. Where a change materially reduces the Service, we will make reasonable efforts to let you know in advance.

17. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and take reasonable steps to notify you — for example, by email or an in-app notice. Your continued use of the Service after the changes take effect means you accept the updated Terms. If you do not agree, stop using the Service and delete your account.

18. Governing law and jurisdiction

These Terms and any dispute arising out of or in connection with them or the Service are governed by the substantive laws of Switzerland, without regard to its conflict-of-laws rules and excluding the United Nations Convention on Contracts for the International Sale of Goods. To the extent permitted by law, the courts of Switzerland have jurisdiction. If you are a consumer, you may also benefit from mandatory protections and court jurisdiction available to you under the law of your country of residence, and nothing here deprives you of those.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force and effect.

20. Entire agreement

These Terms and the Privacy Policy make up the entire agreement between you and the Operator regarding the Service, and replace any prior agreement on that subject. Our failure to enforce any provision is not a waiver of it.
